Lindsay Lohan fails alcohol test again, ordered to court

Lindsay Lohan failed a court-ordered alcohol test last week and will have to go before a judge for a probation violation hearing Thursday morning, according to a source close to the case.
Lohan's failed test, which the source said took place on June 13, comes while the actress is confined to her Venice Beach, California, home because of a jail sentence imposed last month.
The actress will appear before Los Angeles County Superior Court Judge
Stephanie Sautner at 10 a.m. Thursday, the same judge who sentenced her to 120 days in jail after she pleaded guilty to stealing a necklace, a prosecution spokeswoman said Wednesday.
Lohan was allowed to serve a reduced sentence at home because, as a nonviolent offender, she qualified for a home confinement program intended to reduce overcrowding.
But it is not likely Sautner has missed seeing media reports showing Lohan socializing on the roof of her luxury home in recent days.
"When my friends come over, they're not drinking," Lohan told an interviewer with Life & Style magazine. "Alcohol is not in my house, so it's just not a part of my life."
That interview was given on June 18, five days after she allegedly failed the test.
The actress, who turns 25 on July 2, has managed to avoid more than a few days in jail despite two drunk driving convictions, a long list of probation violations and the recent theft conviction.
"Because of budget constraints and because we're under a federal consent decree that requires us to curb our overcrowding situation, nonviolent offenders, lesser crimes, get 20% of their sentence," Los Angeles County Sheriff's spokesman Steve Whitmore said.
Without the latest violation, it was expected she would be released from home confinement in early July. She would then resume her work on 480 hours of community service the judge imposed.
Lohan entered drug rehab last year to avoid a jail sentence imposed by another judge. But Sautner made it clear in court last month that she didn't think drugs and alcohol were the root of Lohan's legal troubles.
"She's got other problems for which she self-medicates," Sautner said.
Lohan's four years in and out of court -- and sometimes jail -- started with two drunken driving arrests in 2007. Since then, she's spent more than eight months in substance abuse rehabilitation programs.
A probation report released last month said the actress "appears to be continuing to struggle with substance abuse issues."
"It would appear that the defendant's criminal conduct is increasing in seriousness and severity," the probation report said, yet it suggested she serve her sentence on probation and not in jail.
Lohan tested positive for alcohol use, a violation of probation rules, in February, the report said.
It also revealed that the drug test failure last August, which resulted in a jail sentence and court-ordered rehab, involved cocaine and amphetamines.

Lohan begins stint under house arrest

Actress Lindsay Lohan turned herself in to Los Angeles jail authorities early on Thursday and has begun serving a sentence for jewellery theft under house arrest, officials said. Lohan, 24, turned up at a Los Angeles jail at 5:00 am on Thursday (local time), according to official records. Los Angeles Sheriff's department spokesman Steve Whitmore told People magazine she was deemed eligible for home confinement, fitted with an electronic monitoring ankle bracelet and released to her home within an hour.
"She is now confined to the interior premises of her home at all times," Mr Whitmore told People. Lohan's lawyer could not immediately be reached for comment. The Mean Girls actress was sentenced two weeks ago to four months in jail and 480 hours of community service after pleading no contest to stealing a $US2,500 gold necklace from a shop in January. It was not immediately clear how much time she would be confined to house arrest. But Mr Whitmore said earlier this month she would likely serve 16-17 days at home under programs for non-violent offenders, good behaviour and because of overcrowding in the city's jails. Lohan has already started her community service at a women's jail. Lohan has been in and out of jail and drug and alcohol rehab for the past four years following a 2007 arrest for drunken driving and cocaine possession. Her troubles have derailed her once-promising Hollywood career, but she was cast in April in an upcoming movie about New York crime boss John Gotti, alongside actors Al Pacino and John Travolta.

Lindsay Lohan expected to serve jail term at home

Actress Lindsay Lohan was sentenced on Wednesday to four months in jail after changing her plea and effectively admitting stealing a $2,500 gold necklace from a Los Angeles store.
But Lohan, who was not in court on Wednesday, will likely serve just 16-17 days of her sentence -- most likely under house arrest, officials said.
"I am glad to be able to put this past me and move on with my life and my career," Lohan said in a statement. "I support the judge's decision and hold myself accountable for being in this situation."
Lohan's lawyer entered a no contest plea on behalf of the actress to a reduced misdemeanor theft charge. Under California law, a no contest plea is an admission of guilt.
Lohan, 24, who has been in and out of jail and drug rehab for almost four years, had previously insisted she was not guilty of deliberately walking out of a store in January without paying for the necklace she was wearing.
Los Angeles Superior Court Judge Stephanie Sautner sentenced the "Mean Girls" actress to 120 days behind bars, 480 hours community service and ordered her to report to jail on or before June 17.
Sautner last month had imposed the same sentence on Lohan for violating her probation, and the two terms will run concurrently.
However, Lohan's lawyer said the actress had applied to serve her sentence at home under a house arrest or electronic monitoring program designed to combat overcrowding in Los Angeles jails.
"As they would with any other defendant with a similar sentence and a minimal criminal history, the Sheriff's Department will determine whether she is eligible for electronic monitoring and early release," attorney Shawn Holley told reporters after the hearing.
Los Angeles County Sheriff's Department spokesman Steve Whitmore, said that under programs for good behavior and because of overcrowding and budget constraints, Lohan would likely end up serving 16-17 days at home.
Whitmore denied that Lohan was getting special treatment because she was a celebrity. "Absolutely not. This is a lower level crime and it is certainly non-violent. It appears that a person like Ms Lohan would be eligible."
Lohan was also ordered to complete psychological counseling and an anti-shoplifting program. "I don't think the root of her problems is substance abuse. I think she has other problems for which she self medicates," Judge Sautner said.
Lohan started her community service last week by working at a women's shelter in Los Angeles.
But Sautner said she could not undertake her community service at the same time as being under house arrest.
"I only hope that she benefits from seeing how other people's lives can become when you lose a couple months pay check," Sautner added.
Lohan's once promising Hollywood career has been stalled since a 2007 drunk driving and cocaine possession arrest, five trips to rehab, and at least three brief stints in jail.
However last month, she landed her first part in a major movie for several years in an upcoming feature about the New York Gotti crime family, alongside actors John Travolta and Al Pacino. Filming is due to start later this year.

Lohan's sexy vampire pics steam up art show

Lindsay Lohan has gone vamp.
The "Mean Girls" star slapped on some fangs and sultry red lipstick to portray a vampire in photographer friend Tyler Shields's photo exhibit, "Life is Not a Fairytale," which debuted Saturday night in an East Los Angeles warehouse.
Check out video, as well as see which partygoers hopped into a nearby casket...
Lohan showed up to the event with her sister Ali to support the exhibit's unveiling, which featured solo shots of the actress as well as her posing with "Vampire Diaries'" star Michael Trevino in a neck-biting situation.

Also, she — and partygoers Emma Roberts and Jenna Ushkowitz who dove right in — cozied up to a casket, too.
"Lindsay loves vampires," Shields told People at the event. "It's well documented that she is a vampire fan, and I said we need to do the craziest vampire mouth shot ever with her mouth."
At least this is better than taking a bite out of um, crime.

Lohan to Leno: I'll be back with an Oscar!

Lindsay Lohan, whose career has been derailed by drunken driving convictions, probation violations and a shoplifting charge, admitted in an interview with talk show host Jay Leno to "poor decisions in the past" -- but predicted an Oscar is in her future.
Lohan, in a "Tonight Show" interview taped Monday and broadcast Tuesday, said she's "willing to do the work that I have to do to follow through with being an actress."
She hopes to be back on Leno's show in a few years with an Oscar, Lohan said.
"I've made a lot of mistakes and I've recognized that, but I'm in the clear now and I feel like as long as I stay focused then I will be able to, you know, achieve what I want to be able to achieve," Lohan told the NBC show's host.

When Leno asked what one thing she would like to change about herself, Lohan said it would be the public perception of her.
"I want the public knowledge to be about my work, not about things that I didn't get into this business for, that I've put myself into positions where that was the bigger story than what I was working on," she said.
Lohan, 24, said she's been cast to play mobster John "Junior" Gotti's wife in a movie, but a 120-day jail sentence and several months of community service for a probation violation threatens to keep her out of the movie. It starts shooting in October.
She is also scheduled to go on trial in June for allegedly stealing a gold and diamond necklace from a Venice, California, jewelry store. If convicted, Lohan could face up to a year in jail.
The 13 days she spent in a Los Angeles jail last summer "was an interesting experience and it was definitely a wake-up call," Lohan said. "And I think when it happened, everything happens for a reason. I don't know exactly what will happen."
Her latest legal setback came Friday when Los Angeles County Superior Court Judge Stephanie Sautner ruled that Lohan violated her probation on two 2007 drunken driving convictions by being arrested for the necklace theft.
Lohan said she was "kind of numb" when Sautner sentenced her to 120 days in jail and 480 hours of community service.
"I was kind of shocked, I didn't really expect the outcome to be what it was, but I'm a big girl and I'm going to do what I'm told to do, continue on with working in my life and I'm taking responsibility," she said.
The actress has admitted a drug addiction in the past, and she's spent at least eight months in substance abuse rehab in the last four years.
She blamed her youth on her bad choices.
"Being young and being in a position that I was in, you don't really take the time to appreciate what you have, and it's all kind of a whirlwind and people make decisions for you," she said. "But I'm not a kid anymore."
Lohan's most optimistic statement came when Leno asked where she sees herself when she turns 30 -- six years from now.
"Hopefully, sitting here after winning an Oscar," Lohan said.

A rollercoaster day for LiLo

Troubled star Lindsay Lohan was ordered to jail for 120 days for violating her probation by allegedly stealing a necklace, but was later released on bail.
Los Angeles County Superior Court Judge Stephanie Sautner also reduced the charge from a felony grand theft to a misdemeanour.
The court ruled on Friday that the ‘Mean Girls' star violated her 2007 drunk-driving probation by wearing a gold chain out of a Venice jewellery store Kamofie & Co in January and failing to return it until the police got involved, reported Los Angeles Times.

Besides 120 days in jail, Judge Sautner gave her 480 hours of community service. The 24-year-old actress was led out of the Airport Courthouse after an afternoon of testimony.
Defence attorney Shawn Chapman Holley immediately sought to post the $75,000-bail and filed an appeal of Judge Sautner's decision.
Ms. Lohan was processed at the Century Regional Detention Facility in Lynwood late on Friday and was released on bail shortly after 9 p.m., said authorities.
The actress will remain free until her June 3 trial but is required to begin her community service by working 120 hours at the Los Angeles County morgue and 360 hours at the Downtown Women's Shelter on skid row, the judge ruled.
Judge Sautner said the assignments would give Ms. Lohan a real-life look at “how truly needy women and women who have fallen on real hard times have to live”.
It was the fourth time Ms. Lohan was sentenced to jail — she spent a few hours twice and 14 days on a 90-day sentence last summer.

Lindsay Lohan: To Jail and Back Again, Part Deux

In court Friday for a preliminary hearing on allegations she stole a $2,500 necklace from an L.A. boutique in January, Lindsay Lohan ended up sentenced to 120 days in jail, and back behind bars for five hours, for violating her probation. Lohan's lawyers plan to appeal the jail sentence, but the actress must immediately start serving 480 hours of community service. Judge Stephanie Sautner did not buy the defense argument that Lohan absentmindedly walked out of the Venice jewelry store wearing the necklace and forgot to return it. The actress did catch a break when Sautner downgraded the charges from felony grand theft to a misdemeanor, a decision that prosecutors plan to appeal. The actress's hearing on the theft charges is set for May 11.

 Before court adjourned, prosecutors argued that Lohan should be jailed for violating her probation, and the judge agreed. Taken into custody immediately, the actress reportedly showed "no emotion" as sheriff's deputies 'cuffed her and took her onto a bus bound for the Lynwood Correctional Facility, a routine that's practically old hat by now. After spending a grand total of five hours behind bars, the actress was let out on $75,000 bail. Meanwhile, Judge Sautner sounded almost impressed with Lohan's proclivity for trouble. "[The necklace] was in fact hidden in plain sight and she walked out of the store," Sautner said. "It's brazenness ... it's ... I don't know what it is."

People: Chris Brown trashes dressing room after 'Good Morning America' appearance (Video)

Chris Brown's occasionally discomforting quest for career rehab hit another roadblock Tuesday, when an appearance on "Good Morning America" concluded with the singer trashing his dressing room and storming shirtless out of the ABC New York studio.
The reported meltdown came off-camera, after an interview with co-host Robin Roberts, who asked him about his 2009 assault of Rihanna, and after he performed a song in the "GMA" studio.
He was scheduled to perform another song after a commercial break, but unidentified witnesses told the Associated Press and other news outlets that Brown went to his dressing room, smashed a window -- reports say shards of glass fell several stories onto the street -- broke
several other items and stormed out as security officers were arriving.
Brown was on "GMA" to plug his new album "F.A.M.E." (the title stands, he says, for "Forgiving All My Enemies") which came out Tuesday and already has garnered three hit singles and largely positive reviews. But Brown clearly seemed agitated when Roberts asked him about the assault and continued to emphasize the new album.
"This album is what I want them to talk about and not what happened two years ago," he said.
Brown is still on probation for the Rihanna assault, but ABC said Tuesday it did not plan to press criminal charges against the singer.
Brown is also slated to appear on ABC's "Dancing With the Stars" next week; and so far the gig is still on.
KESHA NIXES JAPAN SHOW; CYNDI LAUPER DOESN'T: Pop singer Kesha, known for her gleefully raunchy songs and stage shows, says she has postponed an upcoming concert tour in Japan, in deference to the earthquake, tsunami and ongoing nuclear power plant crisis there.
She urged fans to donate to relief funds.
"My heart is with Japan right now through this disaster and these hardships," the singer posted on her website. "I genuinely don't think right now would be appropriate timing for me to perform in Japan given the content and the spirit of my show, which is all about feeling exuberant, rowdy and wild."
But Cyndi Lauper has decided to go on with her current tour in Japan and will use the shows to raise funds for relief efforts.
ANOTHER DAY ANOTHER LOHAN ARREST: There are new legal problems for Lindsay Lohan's father, Michael Lohan. He was arrested by Los Angeles police on three felony charges Tuesday after a woman accused him of domestic violence at a nearby apartment, police say.
Police said they arrested Lohan after receiving a call at 9 p.m. about a domestic dispute. Lohan was detained while he was walking on the street near a police station. Police said he did not appear to be intoxicated and was cooperative.
Lohan, 50, was booked for inflicting corporal injury on a cohabitant, false imprisonment and preventing a report of victimization, police said.
No other details of the alleged incident were revealed.
His daughter Lindsay, meanwhile, is expected to inform a judge by today whether she will accept a plea deal with jail time or go to trial in her felony grand theft case.
Reports say a judge has offered Lindsay Lohan a term of 60 to 90 days in county jail, rather than state prison, if she pleads guilty to grand theft, RadarOnline.com reported.
She could face a worse sentence if she rejects the deal and is later convicted.
Lohan is accused of stealing a $2,500 necklace from a jewelry store near her Venice home last month.
JA RULE BROKE DA RULES: Rapper and actor Ja Rule pleaded guilty Tuesday to failing to file tax returns and will pay more than $1 million in back taxes and penalties, Reuters news service reported.
Ja Rule, 35, whose real name is Jeffrey Atkins, 35, pleaded guilty in Newark federal court to three counts of failing to file a tax return, from 2004 through 2008, even though he was making money from royalties and live tours. Atkins was free after posting $500,000 bail, and will be sentenced June 13. He faces a maximum sentence of one year in prison on each count.

Lindsay Lohan gets extension -- next date, March 25

Lindsay Lohan did not strike a deal with prosecutors who are preparing a case against her for felony grand theft of a designer diamond necklace, but a Los Angeles judge gave the actress more time to decide her plea, setting an interim court date of March 25. Prosecutors and Lohan’s lawyer can continue to work on a plea bargain in the meantime, but Lohan will need to be in court on March 25 if she intends to plead guilty or no contest and accept the parameters of the court’s offer. If she decides to plead not guilty, an April 22 court date has already been set that will hear the felony grand theft case, as well as charges that Lohan has violated conditions of her probation.
Lohan has denied stealing the necklace from a Venice, Calif., jewelry store. The court expects Lohan to inform it of her intentions by March 23.

Sale of surveillance video could help Lohan defense



A Venice jewelry store that reported the alleged theft of a necklace has now sold tapes of the actress with the necklace. Legal experts say the sale could prove the store had a financial incentive to accuse Lohan of theft.
The tabloid frenzy over Lindsay Lohan may have given the actress a new and potent defense as she fights charges that she stole a necklace from a Venice jewelry store.
The jewelry store that reported the alleged theft to the Los Angeles Police Department has now sold surveillance video that shows Lohan with the necklace to the media. Still photos from the video appeared on "Entertainment Tonight's" website, and the video is scheduled to be available at some point on a website run by a firm distributing the tape.
"Many individuals want to be able to see the video streams from the jewelry store's surveillance cameras, and we have obtained the exclusive license for them," said a message placed on the website that plans to stream the video. "The tapes speak for themselves."
The sale of the tape underscores the sometimes uncomfortable nexus of Hollywood's celebrity culture and L.A.'s criminal justice system.
It's unclear exactly what the video shows — and what effect its sale and broadcast will have. Lohan faced felony charges for allegedly stealing the $2,500 necklace — the most serious in a string of recent run-ins she's had with the law.
Sources told The Times that the tape is a key piece of evidence — but not the only one. Paparazzi photos taken days later also show the actress wearing the necklace. The case file includes statements from people who were inside the store at the same time as Lohan, said the sources, who spoke on condition that they not be named because the case is ongoing.
Some legal experts said it could give ammunition to Lohan's defense team, which can now argue the jewelry store had a financial incentive to accuse Lohan of theft.
"I don't care who it is [shown on the video], it's a negative for the prosecution," said James Blatt, a veteran defense lawyer whose clients have included former San Fernando Valley drug dealer and convicted killer Jesse James Hollywood. "Somebody is getting paid and that should not occur."
Blatt and others said the details of what is captured on tape also matter, particularly if she appears to hide the necklace as she leaves the store. "People have to stop and think about it; is this woman [Lindsay Lohan] going to risk everything for a $2,500 necklace?" he said.
Loyola Law School professor Stan Goldman said that if the case does go to trial, Lohan's defense could try to use the payment to attack the credibility of the jewelry store. "If you're the prosecution, you would have rather that this did not happen," he said.
But Glen T. Jonas, also a longtime defense attorney, said the sale of the video doesn't change the images captured on the video and ultimately, shouldn't present big problems for the prosecution's case.
"The video is newsworthy and the public has a right to see it," Jonas said. "It only becomes a problem if a specific employee's testimony is necessary to establish the elements of the charges, and that employee profited from the sale of the video."
He noted that although every case has issues, "if I had to choose between an erratic client who picks up cases monthly, or neutralizing the damage to the credibility of video that speaks for itself, I think I would choose the latter."
Neither L.A. prosecutors nor Lohan's attorney returned calls seeking comment.
Lohan will be back in court Thursday. Her attorney has suggested that she would agree to a plea deal if she would be spared jail time, but the judge has repeatedly said that any deal would involve some incarceration.
"This case does involve jail time — period," Los Angeles County Superior Court Judge Keith Schwartz said. "If you plead in front of me — if this case resolves in front of me — you are going to jail. Period. It may be an issue as to amount of time."
Lohan has been in and out of court and rehab over the last two years. She spent three months at the Betty Ford Center in Rancho Mirage under orders from Los Angeles County Superior Court Judge Elden S. Fox, who spared the actress jail time in October after Lohan had tested positive for drugs while on probation in a DUI case. If she is convicted in the necklace theft, she could serve jail time for that crime and also be eligible for additional detention for violating her probation.
Riverside County prosecutors said they were still considering whether to file charges against Lohan for allegedly shoving an employee at the Ford center last year. The rehab center employee reported that Lohan had assaulted her but has since said she does not want to press charges.

Superstar teen lampoons Lindsay Lohan, Justin Bieber and herself on sketch comedy show. 
For fans of Miley Cyrus last night's "Saturday Night Live" had to seem, like, "pretty cool," as the 18-year-old former Disney Channel Star made her first ever appearance as host on the long running sketch comedy show, alongside musical guest The Strokes.
From the very beginning, Cyrus made it clear she was not above lampooning herself, self-depreciatingly telling viewers during her monologue that "Hannah Montana" was The Disney Channel's version of "Black Swan," before transitioning into "I'm Sorry I'm Not Perfect," a song which managed to walk the fine line of referencing nearly every scandal of the young performer's still burgeoning career without actually apologizing for any of them."There's a photo of me dressed like a dude, and Annie Leibovitz tried to get me nude. For those of you who think that's pretty crude, I'm sorry I'm not perfect," Cyrus belted.
"[I] didn't make a dirty tape, and pass it along. Didn't text a dirty picture of [my] dong," she continued, flanked by cast members Bobby Moynihan and Kristen Wiig. "Don't' both of these things seem worse than a bong? I'm sorry I'm not perfect."
The show's midnight centerpiece was, predictably, "The Miley Cyrus Show," which continued SNL's recent tradition of having the target of their hijinks appear alongside the actor lampooning them. In this case, Vanessa Bayer, whose spot-on impersonation of the giggly, hyper-loquacious Cyrus has become a show highlight, made room on her mock talk show for Cyrus herself, who in her best impression of the night played Justin Bieber.
"Did you know I smoked salvia," Bayer as Cyrus said to her guest.

Screen Captions of Lindsay Lohan's Surveillance Video Released



While talks about Lindsay Lohan's surveillance video are all over the web, a sneak peek to the said footage has hit the web in a form of screen captions. The troubled singer is clearly visible at these images - she is seen inside the store with a companion.
The troubled singer came to Kamofie & Co., a jeweler located near her new home in L.A.'s Venice Beach district, and tried on some jewelry pieces. The pictures were released as a teaser to the video capturing the moment when she allegedly stole a $2,500 necklace from the store.
The footage has been shopped around with its recent price tag reaching around $35,000, and it's expected to come out on Monday night, March 7. It has gone out to the Associated Press, who is handling the licensing and distribution of the tape and stills. Lindsay has been charged with felony grand theft and is due back in court March 10. Since the case is still on going, both the prosecution and defense camps are upset with the video release because they believe it will complicate the case. "Neither side wanted it released," a source told Radar Online. "Neither side sanctioned this sale."
Kamofie & Co. spokesman Christopher Spencer defends the decision to release the tape, claiming that the case ruined their business. "Customers have stayed away from the store because of the paparazzi and the controversy," he said, adding that there is no profit motive because the money made from the release won't come close to covering the loses.
"There were literally thousands of media inquiries asking for the release of the video which is not secret evidence. The video would have been released during the trial anyway, as was stated by several prominent criminal attorneys," he stated. "We worked with the non-profit organization known as the Associated Press to allow legitimate journalists and news outlets access to the video."
